Audaire Health takes the protection and the security of your data very seriously. For this reason, we shall take all reasonable steps to protect your personal data against accidental or unlawful destruction, accidental loss, unauthorized changes, unauthorized disclosure and unauthorized access to the data. In this regard, we conform to the highest standards in the industry when transferring and saving your data.

To make these easier to read, our services, website, internet connected device and mobile application are collectively called the "Services" and Audaire Health Inc. shall be called "Audaire Health."

1 Purpose of collection, processing and use

Audaire Health collects data related to each medication administration event. Personal data may include name, address, telephone number, email address or date of birth, which create a direct link to the associated person. Data associated with medication administration events include, but are not limited to, the date and time of medication use; prescription date(s); dose/strength of prescription(s); name; the dispensed quantity of medication(s); date of birth; the quantity and supply (in days) of medication(s) provided per prescription; medical history; any refill date for medication(s) while using the Service, and other data useful in monitoring and logging medication usage and adherence.

The resulting data will only be released to authorized individuals who are designated to receive the results on their behalf or as directed by the user in writing. Audaire Health shall have access to this data in order to effectively evaluate the Services.

The personal data shall be stored and processed on secure servers provided by Etica, Inc. (DBA VMRacks). Etica, Inc. complies with the Health Insurance Portability and Accountability Act (HIPAA) and the Health Information Technology for Economic and Clinical Health (HITECH) Act.

Your email address is required so you can gain access to your data from a new device at a later point in time. We may use your email address for the purposes of providing customer support.

Audaire Health may send anonymous reports about system errors, crashes and usage behavior to our developers via third-party services . This is the best way to ensure the stability of the Services and provide you with a great user experience.

2 Discretion and protection of your privacy

Health is a sensitive topic. Audaire Health commits to protecting your privacy and assures that it will collect, process and use personal detail in accordance with applicable laws including HIPAA. Per HIPAA, Audaire Health keeps patient information, or PHI, in an encrypted state, whether at rest or in transit. However, no commercial method of information transfer over the Internet or electronic data storage is known to be 100% secure. As a result, we cannot guarantee the absolute security of that information during its transmission or its storage in our systems. Other than the these security measures, you transmit data, including personal information, to us at your own risk.

3 Consent

By providing your consent and using our Services you agree to the regulated use of personal data. Using the Services past the mention of these policies implies consent to the privacy policy.

Consent can be withdrawn at any time by deleting the account connected to the user’s data and notifying the Audaire Health team at hello@audaire.com.

4 Third-party providers

Third parties which may receive anonymous usage data from our apps and websites include: Google Analytics.

5 Disclosure of personal data

Audaire Health shall not disclose any personal data to third parties, except where it is immediately required to provide the Services, as provided in Section 1 of this privacy policy.

If you choose to release your personal data to others, such as when authorizing release of my medical records, the Services data may no longer be covered by federal and state law confidentiality/privacy provisions.

You are free to discuss any questions or concerns that you have about the Services and/or your medication with your pharmacist, prescribing physician, other doctor(s) and/or other pharmacist(s).

6 How your data is secured

Audaire Health uses well-established methods to securely transfer and save your data. To this end, data is transferred via an encrypted transmission (HTTPS) and stored in encrypted databases fields.

Data about usage behavior in the app will be collected and saved and analyzed anonymously by third-party providers mentioned in section 4.

7 Children’s Privacy

Audaire Health does not knowingly collect or use personal data from children under the age of 13. By registering for and using the Services you are required to confirm that you are at least 13 years old.

8 Use of anonymized tracking data

Anonymized data is any data entered in Audaire Health as part of the tracking or otherwise collected in the app, that is not personal data, i.e. an email address, name, or date of birth, or other information that can be directly linked to a person.

By tracking data in Audaire Health, the user consents that their anonymized data may be used by us and third parties for research in medicine as well as market research and/or other purposes. However, in the process of such research, no effort shall be made to identify the user from the anonymized data.
